These Terms of Service ("Terms") govern your use of the website located at www.collinscoastalhomes.com (the "Site") and the text messaging program described below. The Site and program are operated by CalDexCo Inc. DBA Collins Coastal ("Collins Coastal," "we," "us," or "our"), a real estate brokerage practice of John Collins, Coldwell Banker Realty, CA DRE #01948188, Broker DRE #00616212. Please read these Terms together with our Privacy Policy.

Acceptance of these Terms

By accessing or using the Site, submitting a form, creating an account, or agreeing to receive text messages from us, you agree to these Terms. If you do not agree, please do not use the Site or the text messaging program.

About our services

Collins Coastal provides residential real estate brokerage services in San Diego, California, including Pacific Beach, Mission Bay, and surrounding coastal communities. The Site provides property search tools, market information, educational articles, and ways to contact us.

Property information and general content

Listing information and market data on the Site are provided for general consumer use and may be supplied by the multiple listing service (MLS) and other third parties. Information is deemed reliable but is not guaranteed, may contain errors, and may change without notice. Please verify all details independently before relying on them.

Articles, guides, videos, and other content on the Site are for general educational purposes only. They are not legal, financial, tax, or investment advice. Please consult a licensed attorney, CPA, or financial advisor about your specific situation.

Your use of the Site

You agree to use the Site only for lawful purposes and not to:

submit false, misleading, or another person's information, including a phone number you do not own or have authority to use
attempt to gain unauthorized access to the Site or its systems
copy, scrape, or republish listing data or other content without permission
use the Site to send unsolicited advertising or to harass anyone

Accounts and information you submit

If you create an account or submit a form, you agree to provide accurate and current information and to keep any login credentials confidential. You are responsible for activity under your account. Information you submit is handled as described in our Privacy Policy.

Text messaging (SMS) program terms

Program name: Collins Coastal Text Messaging. Sender: John Collins / Collins Coastal, CalDexCo Inc., 888 Prospect St., Suite 140, La Jolla, CA 92037.

What the program is. If you give us your mobile number and consent, we will send you text messages related to your real estate inquiry or transaction. Examples include replies to your questions, appointment scheduling and reminders, showing and open house coordination, updates about transaction progress, requested property or market information, and customer service follow-up.

How you opt in. You opt in by providing your mobile number on a form on our Site (for example, the Contact Us or home valuation forms), by texting or calling us and asking to communicate by text, or by verbally or in writing agreeing to receive texts from us. By doing so you consent to receive text messages from Collins Coastal at the number you provided, including messages sent using an automated system. Consent to receive text messages is not a condition of purchasing any property, goods, or services.

Message frequency. Message frequency varies based on your inquiry and activity. We do not send messages unless you have asked us to or have given your consent.

Costs. Message and data rates may apply. Your mobile carrier may charge you for messages sent and received. We do not charge for the program itself.

How to opt out. You can cancel text messages at any time by replying STOP to any message. After you reply STOP, you will receive one confirmation message and no further texts from that number. You can also call us at (858) 252-0200 or email John@CollinsCoastalHomes.com to opt out. To start receiving messages again, reply START or contact us.

How to get help. Reply HELP to any message for assistance, or contact us at (858) 252-0200 or John@CollinsCoastalHomes.com.

Carriers. Supported carriers are not liable for delayed or undelivered messages. Text messaging availability and delivery depend on your carrier and are not guaranteed.

Privacy of your mobile information. We do not sell your personal information. Mobile opt-in data, including your phone number and text message consent, will not be shared with or sold to third parties or affiliates for marketing or promotional purposes. We use it only to send the messages you asked for and to operate our business as described in our Privacy Policy.

Content we do not send. We do not use this program to send loan offers or lending arrangements, age-restricted content, or messages unrelated to your real estate inquiry.

Intellectual property

The Site and its content, including text, graphics, logos, photographs, videos, and the compilation of listing data, are owned by or licensed to Collins Coastal or its data providers and are protected by copyright and other laws. You may view and print content for your personal, non-commercial use. Any other use requires our written permission.

Third party websites and services

The Site may link to websites and services operated by others, such as lenders, inspectors, mapping tools, and the MLS. We do not control and are not responsible for their content or practices. Your use of those sites is governed by their own terms and policies.

Disclaimer of warranties

The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error free, or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, Collins Coastal and its owners, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or the text messaging program. Nothing in these Terms limits liability that cannot be limited under applicable law, including any duties owed to you under a written agency or listing agreement with us.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Any dispute relating to the Site will be brought in the state or federal courts located in San Diego County, California.

Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "last updated" date. Your continued use of the Site or the text messaging program after changes are posted means you accept the updated Terms.
